01:34 PM -- House Bill 15-1060

The committee was called to order. A quorum was present. Representative Hamner, prime sponsor, presented House Bill 15-1060, concerning protection orders in sex offense cases. Representative Hamner discussed legislation previously considered by the General Assembly concerning stalking, and explained how the protections afforded victims of stalking would be afforded to all sex offense cases under HB 15-1060. Representative Hamner responded to questions regarding the codification of current practice in the judicial system by the bill. The following persons testified regarding HB 15-1060:

Mr. Tom Raynes, Representing the Colorado District Attorneys' Council, testified in support of the bill. Mr. Raynes discussed the need for the legislation, and explained the current process observed by the judiciary in Colorado pertaining to protection orders. Mr. Raynes responded to questions regarding the benefits of the acknowledgement of a protection order in writing by a sex offense case defendant before being released on bond. Mr. Raynes responded to questions regarding the potential for the bill to create unnecessary bonding delays in certain situations.

Ms. Peg Ackerman, representing the County Sheriffs of Colorado, testified in support of the bill. She supported it as a victim-protection bill.

Representative Willett, prime sponsor, presented House Bill 15-1021, concerning statutorily established time periods that are multiples of seven days. Representative Willett provided background on the use of the "rule of seven," through which the court system attempts to create uniformity in judicial deadlines and scheduling. Representative Willett explained how the bill would conform certain processes pertaining to motor vehicles to the rule of seven. He discussed some auxiliary benefits of the bill. Representative Willett responded to questions regarding the basis of the rule of seven, and the public's opinion of the legislation. Representative Willett responded to further questions regarding the potential for future rule of seven bills to be entertained by the General Assembly.
