Representative KC Becker, sponsor, presented Senate Bill 15-119, concerning the continuation of the regulation of pesticide applicators by the Department of Agriculture. The bill continues the Pesticide Applicator's Act (PAA) until September 1, 2024. Representative Becker distributed and explained Amendment L.001 (Attachment A). The amendment makes several changes to the bill, including shortening the sunset period from 2024 to 2020. Representative Becker responded to questions from the committee regarding Amendment L.001 and distributed Amendment L.004 (Attachment B), which amends Amendment L.001.

Mitch Yergert, Department of Agriculture, and John Scott, Department of Agriculture, spoke in support of the bill. Mr. Yergert explained that the department would support the bill as amended by Amendment L.001 and Amendment L.004. Mr. Yergert also explained that the department would prefer a nine-year sunset, rather than a five-year sunset. Mr. Yergert responded to questions from the committee regarding retention of records by pesticide applicators. Mr. Scott responded to questions from the committee concerning the difference between commercial applicators, limited commercial applicators, public applicators, and individual use or private applicators. Mr. Yegert and Mr. Scott also commented on the sunset period of pesticide applicators.

Shayne Madsen, Rocky Mountain Agribusiness Association (RMAA), spoke in support of the bill and distributed comments in support from RMAA, Coloradans for Responsible Pesticide Applicators, and the Colorado Ag Council (Attachment C). Ms. Madsen responded to questions from the committee regarding the amendments that were distributed.

Kelly Gouge, Green Industries of Colorado (GreenCo), spoke in support of the bill and stated that GreenCo would support a longer sunset period.

Michael Nicoletti, Department of Regulatory Agencies, spoke in support of the bill. Mr. Nicoletti explained how a sunset period is established and that a nine-year sunset would be appropriate for pesticides applicators. Mr. Nicoletti responded to questions from the committee concerning different sunset periods.

Sue Anderson, People and Pollinators Action Network (PPAN), spoke in support of the bill. Ms. Anderson stated that the regulation of pesticides is important and discussed the dangers of pesticides. Ms. Anderson stated that PPAN is concerned about the toxicity of pesticides and stated that the sunset period should be shorter than nine years. Ms. Anderson responded to comments from the committee.

Rella Abernathy, City of Boulder, spoke in support of the bill and explained her background to the committee. Ms. Abernathy explained the changes Amendment L.001 makes to the Pesticide Applicator Advisory Committee and responded to questions from the committee.

Beth Conrey, Colorado State Beekeepers Association and PPAN, spoke in support of the bill and responded to questions from the committee regarding the health of honeybees.
