Rachel Harlow-Schalk, Director of Financial Assistance, Colorado Department of Local Affairs, introduced the Governor's appointment to the Energy Impact Assistance Advisory Committee and discussed the duties of the committee.

Senator Crowder, sponsor, described the provisions of House Bill 15-1074 concerning board of county commissioners member liability and distributed Amendment L.001 (Attachment B). The bill prohibits a judgment against a board of county commissioners arising solely from an act of the board from being enforced against an individual member of the board.

Pat Ratliff, Colorado Counties, Inc., spoke in support of the bill and Amendment L.001, and discussed recent litigation against a member of the Elbert County Board of County Commissioners related to a violation of campaign finance laws. She also responded to questions from the committee about current law concerning government immunity for county commissioners and the potential effect of the bill.

Peg Perl, Colorado Ethics Watch, explained that her organization is neutral on the bill and Amendment L.001. She also discussed recent litigation against a member of a board of county commissioners and spoke in support of expanding liability to additional government bodies.

Ted Ort, Associated Governments of Northwest Colorado, spoke in support of the bill and Amendment L. 001.

Susan Shick, resident of Elbert County, submitted an e-mail opposing the bill (Attachment C).
