07:31 AM -- Consideration of Capitol Complex Master Plan

The committee was called to order. A quorum was present. Ms. Carol Lewis, Manager of State Building Programs, and Mr. Larry Friedberg, State Architect, both of the Office of the State Architect within the Department of Personnel and Administration (DPA), briefed the committee on the Capitol Complex Master Plan (master plan) completed pursuant to Senate Bill 13-263. Committee members received a packet of slides forming the basis of the presentation (Attachment A). Ms. Lewis provided background on the Capitol Complex and the need for a capital planning process for the complex. Ms. Lewis relied on Attachment A to brief the committee. Discussion ensued regarding the functions of Camp George West. Ms. Lewis discussed space needs for the agencies occupying the Capitol Complex. Mr. Friedberg and Ms. Lewis responded to questions regarding the cost for leasing space adjacent to the Capitol Complex. Ms. Lewis discussed the factors driving leasing of private space for housing state agencies.

Ms. Lewis discussed master plan recommendations pertaining to the condition of the facilities in the Capitol Complex, as well as the major findings of the master plan, including urban design recommendations. Ms. Lewis provided an overview of the master plan's recommendations. Discussion ensued regarding the weighing of functionality and aesthetics in creating the master plan. Mr. Friedberg responded to questions regarding the fulfillment of SB 13-263 by the DPA through contracting for the master plan.

Mr. Friedberg clarified that individual capital projects recommended by the master plan require separate approval by the committee through the capital process. Discussion ensued regarding potential economic impacts of adopting the urban design recommendations in the master plan, including the potential tax impacts of the master plan's recommendations. Mr. Friedberg clarified the functions of a task force associated with the master plan, and a separate capital construction planning unit that may be the subject of forthcoming legislation. Ms. Lewis provided input on the tax revenue issues. Discussion ensued regarding the time horizon for approving the master plan.

Discussion ensued regarding the additional information that should be considered by the committee before the master plan is approved, and the options available to the committee for adjusting the master plan. Ms. Kori Donaldson, Legislative Council Staff, provided input on the committee's schedule over the next few weeks, including the potential for revisiting the master plan. Discussion followed regarding other states that have engaged in planning processes similar to the master plan.

08:20 AM -- Discussion on Potential Committee Legislation

Ms. Esther van Mourik, Legislative Legal Services, initiated a discussion about two draft pieces of Joint Budget Committee legislation: (1) concerning an automatic funding mechanism for payment of future costs attributable to certain of the state's capital assets (Attachment B); and (2) concerning the creation of a capital reserve in certain cash funds (Attachment C). Ms. van Mourik provided an overview of the draft legislation in Attachment B, and explained its relationship to Attachment C. Discussion ensued regarding the status of cash funding under the proposed legislation in Attachment B, and the application of the draft legislation to state agencies operating as enterprises.

Ms. van Mourik responded to questions regarding the potential for cash funds reserved under the bill to eventually be diverted to the General Fund, and the potential impact of the draft legislation on sources of federal funding. Ms. van Mourik responded to questions regarding discussions within the Joint Budget Committee about these issues, and the overall intent of the legislation. Discussion returned to the potential for protecting the moneys reserved under the bill from diversion to the General Fund. Ms. van Mourik responded to questions regarding the inclusion of higher education cash funds and higher education revenue bond intercept projects within the scope of the legislation.

Discussion ensued regarding the management of moneys for controlled maintenance by higher education institutions. Ms. van Mourik responded to questions regarding the exclusion of information technology projects by the draft legislation. Ms. van Mourik further explained the purpose of the draft legislation contained in Attachment C, and noted the status of the draft legislation.
