Representative Court, chair, called the meeting to order. Several committee members introduced the gifted and talented students shadowing them for the day.


11:20 AM -- HB15-1054

Representative Brown, sponsor, introduced House Bill 15-1054. The bill, as amended by the House State, Veterans, and Military Affairs Committee, allows a person to operate an off-highway vehicle (OHV) on an unpaved county road if the person has a driver's license, registers the OHV with the Department of Revenue, and obeys the rules of the road. Representative Brown stated the bill provides uniform registration and roadway access statewide for OHVs. He also spoke about the fiscal impact of the bill and several proposed amendments.

11:36 AM -- Sergeant Dave Hall, representing the Colorado State Patrol, testified in opposition to the bill. Because the proposed amendments do not require the licensing and insuring of OHVs, the Colorado State Patrol opposes the bill. Sgt. Hall responded to committee questions on whether the issue needs to be studied by a legislative interim committee. He noted that the Colorado State Patrol and other stakeholders plan to address the issue of OHVs in the interim. He also addressed the fiscal impact of the bill on the Colorado State Patrol.

11:45 AM -- Mr. Tony Lombard, representing Colorado Counties Inc., testified in support of the bill. He stated the counties support the bill's emphasis on local control. He noted that counties plan to work for solutions over the interim with the Colorado State Patrol and other stakeholders. He responded to questions regarding the fiscal impact of the proposed amendments.

12:07 PM -- HB15-1014

Representative Dore, sponsor, introduced House Bill 15-1014. The bill adjusts the registration interval for seasonal farm motor vehicles from 12 months to 24 months and reduces the registration fee. In addition, the bill reduces the amount of specific ownership tax for seasonal farm motor vehicles by half. Representative Dore distributed a fiscal note memorandum and spoke to proposed amendments. In response to committee questions, Representative Dore noted that seasonal farm motor vehicles are defined in statute and currently get a special license plate to denote their status.

12:12 PM -- Ms. Amber Clay, representing Clay Land and Livestock and the Colorado Farm Bureau, testified in support of the bill. She spoke about her personal experience with seasonal farm motor vehicles. She noted the bill benefits the agricultural community because it reduces the costs and burdens for owning a seasonal farm motor vehicle. Committee discussion ensued regarding the impact of the bill on local school financing.

12:19 PM -- Ms. Erin Reynolds, Legislative Council Staff, came to the table to answer questions regarding the fiscal note. She noted the bill reduces specific ownership tax revenue collections. Because an average of 26 percent of special ownership tax contributes to the local share of school finance, funds must be backfilled with General Fund monies.
