Representative Joshi introduced House Bill 15-1179. The bill requires the Department of Health Care Policy and Financing (HCPF) to establish a matching system for determining whether a third-party insurer or self-insured plan is responsible for a Medicaid client's medical expenses resulting from an accident or injury. Prior to paying $2,000 or more on a bodily injury claim, an insurer or self-insured plan is required to exchange information with HCPF to determine if an insurance claimant is a Medicaid client. If HCPF determines that there is a match, HCPF will provide a notice of lien to the insurer or plan for the recovery of medical expenses. Representative Joshi responded to questions from the committee and Representative Melton distributed a handout (Attachment A).

Bob Douglas, Colorado Department of Health Care Policy and Financing, testified in opposition to the bill. He stated that Medicaid is the payer of last resort when a client has other insurance or a third party is responsible for paying the claim. He explained that the department may recover from personal injury settlements, and listed the amount that the department was able to recover in the last year. Mr. Douglas explained the department's opposition to the bill. He stated that the department has not had to sue an insurance company to recover the lien in the past 10 years because current law provides a sufficient recovery process for third-party payments. He responded to questions from the committee. Representative Joshi distributed amendment L.001 (Attachment B).
