Representatives Pabon and Rankin, co-prime sponsors, introduced House Bill 15-1387. Beginning July 1, 2015, the bill prohibits a medical marijuana business that receives a retail marijuana establishment license from transferring any of its medical marijuana inventory to the new retail marijuana establishment. Representative Pabon discussed the history behind the transfer targeted by the bill. In response to a committee question, Representative Pabon clarified that the bill ends transfers from medical marijuana to retail marijuana.

Committee discussion ensued regarding medical marijuana, retail marijuana, and the specifics of the bill. Representative Rankin discussed the tax implications of the bill.

12:13 PM -- Mr. Ron Kammerzell and Mr. Lewis Koski, representing the Department of Revenue, came to the table to answer questions. Mr. Koski discussed the history of the transfer process. Mr. Kammerzell noted that currently businesses can only transfer plants and products. In response to committee questions, Mr. Koski discussed the volume of marijuana transferred. Mr. Kammerzell noted that the first 300 retail marijuana businesses were all medical marijuana businesses that transferred plants and product. Representative Rankin noted that this transfer situation only exists because businesses had inventory problems when retail marijuana licenses were first introduced.

12:36 PM -- Mr. Shawn Coleman, representing 36 Solutions and several marijuana businesses, testified in opposition to the bill. He discussed the amendments and addressed his clients' concerns with the bill.

12:43 PM -- Mr. Mike Elliot, representing the Marijuana Industry Group, testified in opposition to the bill. He discussed his group's issues with the bill. He noted the marijuana industry's willingness to pay excise taxes if businesses are still allowed to transfer the plants and product.

12:50 PM -- Mr. Jason Worf, representing the Southern Colorado Cannabis Council, testified in opposition to the bill. He discussed the opposition from small marijuana businesses to the bill.

12:55 PM -- Mr. Tyler Henson, representing the Colorado Cannabis Chamber of Commerce, testified in opposition to the bill. He discussed the financial implications of the bill on marijuana businesses in Colorado.
