Representatives Conti and Fields, prime sponsor, presented House Bill 15-1341, concerning increasing the penalty from a class 6 felony to a class 5 felony for sexual exploitation of a child by possession of sexually exploitative material. Ms. Peg Ackerman, representing the County Sheriffs of Colorado, testified in support of the bill. Committee members received a flyer in support of the bill (Attachment B). Ms. Ackerman discussed the current penalty for certain types of child exploitation associated with possession of sexually exploitative material.

Ms. Diana Goldberg, representing Sungate Kids Childrens Advocacy Center, testified in support of the bill. Ms. Goldberg discussed her organization's work with kids who have been subjected to sexual abuse, and the impacts of this abuse. Ms. Goldberg discussed ways to combat such abuse. Ms. Goldberg responded to questions regarding the nexus between possession of child pornography and child sexual exploitation.

Mr. Michael Dougherty, representing the First Judicial District, testified in support of the bill. Mr. Dougherty discussed efforts on the part of law enforcement to combat child pornography, and the victimization of children by this crime. Mr. Dougherty discussed the importance of increasing the penalty for possession of child pornography. Discussion ensued regarding exceptions to child pornography laws, and the effect of the bill on these exceptions.

Mr. Mark Hurlburt, representing the Colorado District Attorneys' Council, the Denver District Attorney's Office, and the Eighteenth Judicial District, testified in support of the bill. Mr. Hurlburt, discussed the victims of child pornography crimes, and the deterrent effect of increasing penalties for child pornography. Mr. Hurlburt responded to questions regarding the fiscal impact of the bill. Ms. Kerry White, Legislative Council Staff, provided input regarding the fiscal impact. Discussion ensued regarding the penalties assessed to possessors of child pornography under the bill as compared to the penalties for producing child pornography.
