Representative Tyler, chair, called the meeting to order. A quorum was present. Representative Tyler commented on amendments and pre-amended versions for Senate Bill 14-125 that have been placed on the members' desks. Representative Foote, prime sponsor, presented House Bill 14-1356. The bill increases the penalties for violations of the Oil and Gas Conservation Act. The maximum daily fine is increased from $1,000 to $15,000 for each act of violation per day that the violation continues. The $10,000 maximum cap on violations that do not result in a significant adverse impact is repealed. The Colorado Oil and Gas Conservation Commission (COGCC) in the Department of Natural Resources (DNR) is required to:

• promulgate rules to establish the basis for determining the duration of a violation for purposes of imposing the applicable penalty, using presumptions specified in the bill;
• publish a quarterly report on its website that lists specific information on penalties assessed; and
• present penalty information during the annual DNR hearings before the General Assembly committees of reference.

The COGCC is required to hold a hearing if there is evidence that an operator is responsible for gross negligence or knowing and willful misconduct that results in an egregious violation. After a hearing in which the operator is found responsible, the COGCC may issue an order that prohibits issuance of new permits to the operator, suspends any or all of the operator's certificates of clearance, or both. The COGCC may vacate the order once the operator has come into compliance and all penalties have been paid.

Representative Foote discussed the provisions of the bill and noted that the bill is a result of many negotiations and meetings and that there are a lot of important stakeholders in support of the bill. Representative Lawrence asked for more information about fines that are levied by inspectors. Representative Foote commented on the inspection process. Representative Mitsch Bush asked about public and legislative oversight.

Patrick Pratt, representing the South Metro Denver Chamber (SMDC), testified in support of the bill. He said that the bill is better than House Bill 13-1267, on which the SMDC was neutral. He responded to questions from the committee.

Matt Lepore, representing COGCC, and Bob Randall, representing DNR, testified in support of the bill. Mr. Randall said that the bill will modernize the penalty provisions and is a product of collaboration between the sponsor, the department, and the industry. Mr. Lepore thanked the sponsor for engaging collaboratively with the Governor's Office and the industry. He commented on the impact of the bill on COGCC.

The committee came back to order. Representatives Pabon and Szabo, co-prime sponsors, presented Senate Bill 14-125. The bill creates a limited regulatory structure for transportation network companies (TNCs) that use digital networks to connect riders to drivers who provide transportation in their personal vehicles. TNCs are exempt from the regulation for common carriers, contract carriers, and motor carriers but must be permitted by the Public Utilities Commission (PUC) in the Department of Regulatory Agencies as long as they meet certain requirements. These include:

• filing a certificate of insurance with the PUC for $1 million per occurrence;
• requiring personal automotive liability insurance for all drivers;
• conducting a vehicle safety inspection prior to providing service, and a minimum of one safety inspection per vehicle per year;
• obtaining criminal history record checks and driving history reports on prospective drivers; and
• prohibiting the use of drivers with certain felony convictions or moving violations.

Fees for a one-year permit are set in statute at $325 to be deposited into the newly created, and continuously appropriated, Transportation Network Company Account in the PUC Motor Carrier Fund. The PUC may promulgate rules concerning administration, fees, safety requirements, and financial responsibility requirements. After the first year, fees must be set and adjusted by rule to cover the PUC's direct and indirect costs for regulation of TNCs. The PUC may take an enforcement action against a TNC. A TNC that fails to comply with a PUC order, decision, or rule is subject to a penalty of up to $2,000 per offense. The PUC cannot assess a penalty against a TNC driver.


Witness testimony on Senate Bill 14-125 was heard on April 2, 2014. Representative Tyler discussed how the amendment phase would be structured. Representative Kraft-Tharp thanked the bill drafter for her hard work.
