Representative Sonnenberg, sponsor, presented HB14-1064 concerning the distribution of severance tax revenue to a local government that limits oil and gas extraction. The bill prohibits any local government with a moratorium or prohibition of oil and gas extraction from receiving more assistance from the Local Government Severance Tax Fund than it received in the fiscal year that the moratorium or prohibition was enacted.

The committee asked questions concerning revenue and moratoriums. Representative Rankin discussed a study on the moneys used to offset the impact of oil and gas.

Kevin Bommer, representing the Colorado Municipal League, spoke in opposition of the bill. He discussed severance tax distribution in areas impacted by mineral development based on population, permits, and production. Mr. Bommer said that a moratorium is a temporary measure and that a cap on severance tax would punish communities over a length of time.

Representative Dore discussed communities that have chosen to prohibit production of oil and gas. Mr. Bommer said that the impact would still have an affect on counties not directly associated with production.

The committee discussed land use policy in relation to oil and gas production.

Representative Gardner discussed the distribution of a severance tax to impacted communities versus non-impacted communities. Representative Sonenberg provided a summary of the bill's provisions.
