Representatives Gardner and Ginal, prime sponsors, presented House Bill 14-1310, concerning the provision of breath-testing devices to law enforcement agencies. Committee members received a fact sheet on the breathalyzer program (Attachment A). Representative Ginal provided background on efforts undertaken by the General Assembly to secure funding for breathalyzers for law enforcement in recent years, and explained the effect of the bill. Representative Gardner further explained the effect of the bill, and discussed its fiscal impact. Discussion ensued regarding the source of cash funding for the breathalyzer program, and appropriations associated with the program.

Mr. Dave Hall, representing the Colorado State Patrol, testified in support of the bill. Mr. Hall discussed the phasing out of obsolete breathalyzers in recent years, and the need to replace these machines. He discussed the importance of breathalyzers to the law enforcement mission.

Dr. Laura Gillim-Ross, representing the Department of Public Health and Environment, testified in support of the bill. Dr. Gillim-Ross discussed recent efforts to secure funding for new breathalyzers, and her department's role in maintaining the breathalyzer inventory. Dr. Gillim-Ross responded to questions regarding the plan for funding breathalyzer purchases in the future, and the use of hand-held breathalyzers by law enforcement.
