Representative Williams, chair, called the meeting to order. A quorum was present. Representative Rosenthal presented House Bill 14-1344, concerning the use of electronic means to document transactions related to the business of insurance. The bill allows an insurance company to provide its policyholders with policy-related documents electronically with policyholder consent. A policyholder may withdraw consent at any time, which reinstates the insurance company's obligation to provide the documents in hard copy. Standard property and casualty insurance policies and endorsements may be posted on an insurance company's website if:

Representative Rosenthal explained that this bill represented an "opt-in" paperless initiative. He responded to questions from the committee about the type of notices that were included in the bill.

Kelly Campbell, representing Property Casualty Insurers Association of America (PCI), testified in support of the bill. Ms. Campbell stated that PCI sees this as a modernization bill. Ms. Campbell provided an overview of the two sections of the bill: 1) electronic delivery of documents, and 2) Internet posting of standard insurance provisions. Ms. Campbell responded to questions from the committee about privacy concerns.

Representative Rosenthal distributed and discussed Amendment L.001 (Attachment A). He stated that the amendment removes fees and makes the bill general to insurance companies. He responded to questions about stakeholder support for the amendment's removal of "property and casualty."
