The committee was called to order. A quorum was present. Representative Levy, prime sponsor, presented HB 13-1182, concerning the creation of the Legislative Digital Policy Advisory Committee. Committee members received prepared amendment L.002 (Attachment A). The bill requires the committee to formulate plans for converting archived legislative recordings to a digital format. Representative Levy discussed the origins of the bill, and explained its effect. Representative Levy responded to questions regarding the membership of the committee created by the bill, and the form of legislative archival records from the years 1973 through 2001. Representative Wright, prime sponsor, presented House Bill 13-1045, concerning prohibiting assistance by the state with enforcement of certain provisions of the federal "National Defense Authorization Act for Fiscal Year 2012," for action only. Representative Landgraf, prime sponsor, presented House Bill 13-1187, concerning the inapplicability of certain federal firearms laws within Colorado. Representative Landgraf discussed certain constitutional provisions that pertain to the bill, addressing potential concerns about the constitutionality of the bill.

Ms. Annmarie Jensen, representing the Colorado Association of Chiefs of Police, testified in opposition to the bill. Ms. Jensen discussed potential issues of federal supremacy that the bill may raise, and the difficult circumstances passage of the bill would place on police officers who would be required to observe both state and federal law.

Ms. Eileen McCarron, representing Colorado Ceasefire, testified in opposition to the bill. Ms. McCarron explained how the bill would affect police officers attempting to enforce both state and federal laws, and questioned the constitutionality of the bill. Ms. McCarron recounted the beginning of the Civil War and explained that House Bill 13-1187 potentially rejects federal authority. She also discussed her organization's love of country.

Mr. Dan Meyer, representing himself, testified in support of House Bill 13-1187. Mr. Meyer discussed his recent political activities, and government efforts to erode Second Amendment rights. Mr. Meyer discussed positions taken on gun ownership by certain individuals, and objected to the positions and actions taken by the current presidential administration in the area of gun ownership. Mr. Meyer discussed the use of tax dollars by the government to undertake actions to which he objects.

Mr. Kirk Fry, representing himself, testified in support of the bill. Committee members received copies of the state's oath of office (Attachment E). Mr. Fry discussed the importance of upholding this oath of office and adhering to the intentions of the nation's founding fathers.

Ms. Linda Mackety, representing herself, testified in support of House Bill 13-1187. Ms. Mackety read a quote from Judge Andrew Napolitano regarding the Second Amendment, and also read a letter she recently forwarded to her state representative concerning gun control laws.

Ms. Suzanne Morrison, representing herself, testified in support of the bill. Ms. Morrison spoke against the federal government infringing upon Second Amendment rights, and spoke against disarming women. She read a quote by George Washington.

Ms. Mary Tuneberg, representing herself, testified in support of House Bill 13-1187. Ms. Tuneberg asked the committee to support Second Amendment rights, and suggested that more people and businesses may relocate to Colorado if they are supported. Ms. Tuneberg addressed testimony previously provided by Ms. Jensen, and spoke in support of the right of self defense.

Mr. Harry Hilgers, representing himself, testified in support of the bill. Mr. Hilgers discussed his naturalization as a U.S. citizen, and discussed the disarming of Europeans and how this impacted Europeans during the World War II era. Mr. Hilgers discussed the potential impact of disarming U.S. citizens.

Representative Humphrey, prime sponsor, presented House Bill 13-1169, concerning allowing a valid Colorado concealed handgun permit to substitute as an otherwise required criminal background check pursuant to the transfer of a firearm. Representative Humphrey explained the effect of the bill. The following persons testified regarding House Bill 13-1169:

Ms. Eileen McCarron, representing Colorado Ceasefire, testified in opposition to the bill. Ms. McCarron explained the purpose of conducting background checks on those seeking to acquire a firearm. She explained that those who have undergone background checks in order to obtain a concealed carry permit do not always maintain clean criminal records for the five-year period between required background checks.

Ms. Annmarie Jensen, representing the Colorado Coalition Against Domestic Violence and the Colorado Association of Chiefs of Police, testified in opposition to the bill. Ms. Jensen explained that in some instances concealed carry permits are required to be rescinded by local sheriffs for violations of law, but this is not done in a timely manner. Ms. Jensen responded to questions regarding how sheriffs revoke concealed carry permits, and the authority of sheriffs to confiscate weapons when they revoke the permits.

Mr. Harry Hilgers, representing himself, testified in support of House Bill 13-1169. Mr. Hilgers discussed the redundancy of background checks for those holding concealed carry permits who wish to accept transfer of a firearm from a firearms dealer, and the costs associated with this additional background check. Mr. Hilgers discussed the lives saved due to use of firearms.

Mr. Kirk Fry, representing himself, testified in support of the bill. Mr. Fry rebutted previous testimony, citing the research of Dr. John Lott pertaining to the use of firearms for self defense. He discussed the effect of issuing concealed carry permits on the violent crime rate.
