Representative Vigil, sponsor, presented House Bill. 13-1168. Current law recognizes acequia ditch corporations, but limits the status to irrigation systems that supply irrigation water to long lots that are perpendicular to the stream or ditch to maximize the number of landowners who have access to the water. The bill repeals this limitation, allowing water from an acequia ditch to be used on lands with configurations other than long lots. The bill also allows an unincorporated association to operate as an acequia ditch.

Lawrence Gallegos, Acequia Association, spoke in support of the bill. He spoke about some of the history of Conejos County, where he resides as a sixth generation rancher, and how it relates to this bill.

Joseph Gallegos, Costilla County and Acequia Association, spoke in support of the bill. He explained why he would like to see the definition of acequia expanded and he discussed the heritage and culture surrounding unincorporated acequia ditches.

Peter Nichols, Sangre de Cristo Acequia Association, spoke in support of the bill. He discussed the amendment L.001 (Attachment B), which staff distributed to the committee. Mr. Nichols talked about the importance of the amendment as it protects members of unincorporated acequia associations from personal liability. Mr. Nichols also discussed why some acequia ditches have been shut down in recent years, and how incidences like this will be treated in the future.
