12:06 PM -- House Bill 13-1305 - Concerning the Master Settlement Tobacco Settlement


Representative Gerou and Representative Levy, prime sponsors, explained the provisions of the bill. Representative Levy began by distributing a Joint Budget Committee (JBC) fact sheet (Attachment A) and Amendment L.001 (Attachment B) to committee members. Representative Gerou noted that as a JBC bill, House Bill 13-1305 authorizes the Governor to order the State Treasurer to transfer up to $40 million from the General Fund to the Tobacco Litigation Settlement Cash Fund, if tobacco litigation settlement moneys are reduced as a result of pending arbitration.

12:10 PM -- House Bill 13-1297 - Concerning Investments Related to Higher Education

Representative McLachlan and Representative Schafer, prime sponsors, explained the provisions of the bill. Representative McLachlan noted that House Bill 13-1297 grants investment authority and fiduciary responsibility for all funds and appropriations to the board of trustees at the Colorado School of Mines (CSM) and the board of trustees at Fort Lewis College. If the boards choose to exercise investment authority, the bill requires that they create an investment advisory committee and a written investment policy.

The committee discussed the rate of return and level of risk that is associated with State Treasury investments as compared to investments that would be authorized under the bill.

He closed by discussing the liquidity issue that requires investments to be available for certain state uses if needed. The committee continued the discussion on investment risk under the bill.

01:01 PM -- House Bill 13-1292 - Concerning Requirements for Government Contracts

Representative Lee and Representative Pabon, prime sponsors, explained the provisions of the bill. Representative Lee noted that House Bill 13-1292 makes changes to contracting requirements for state and local government agencies, including changes to the enforcement of the 80 percent labor law, the preference for resident bidders, the addition of competitive sealed best value bidding, and the modification of disclosure requirements related to outsourcing services, labor, and manufactured goods. It also requires the Public Utilities Commission to consider best value employment metrics in connection with the construction or expansion of generating facilities.

The committee engaged in a discussion about the impacts in the fiscal note and the cost to small businesses. After committee discussion, staff was asked to respond to questions about the fiscal impacts in the bill.

02:08 PM -- House Bill 13-1251 - Concerning DNA Collection of Misdemeanor Offenders

Representative Pabon, prime sponsor, explained the provisions of the bill. He noted that currently, an offender convicted of a misdemeanor is only required to provide a sample of his or her genetic material (DNA) for inclusion in the state's database if the offense involved unlawful sexual conduct. He continued by saying that under House Bill 13-1251 the law would require any offender convicted of a class 1 misdemeanor offense on or after July 1, 2013, to provide his or her DNA.

The committee discussed the expenditure impacts in the fiscal note. After a brief discussion, Representative Pabon distributed a revised Legislative Council Staff impact statement (Attachment D) and discussed the changes in the fiscal note. Staff was asked to respond to questions about the fiscal note.
