09:07 AM -- Introductory Remarks

President Morse, chair, called the meeting to order.

Mike Mauer, director of the Legislative Council Staff, gave the committee some introductory remarks regarding the 2013 Colorado Blue Book. Copies of the meeting materials are posted online at the Legislative Council website. He gave an overview of the Blue Book process and noted that it takes 12 votes, two-thirds of the committee membership, to make any changes to the analysis. Mr. Mauer responded to questions from Representative Court and discussed the current layout of the Blue Book and noted that the committee can decide to adjust the layout if it chooses.

Clare Pramuk, Legislative Council Staff, discussed the proposed Blue Book analysis of Proposition AA concerning retail marijuana taxes. She gave the committee an overview of each section of the analysis, including a summary and analysis of the proposed proposition, an estimate of its fiscal impact, and arguments for and against the proposition.




Representative Murray presented prepared Amendment 1 to Proposition AA concerning language discussing retail licenses for medical marijuana stores in the summary and analysis section (Attachment A). The committee discussed whether the existing language was misleading or unnecessary.

After committee discussion regarding the use of language concerning medical marijuana, Representative Murray offered a conceptual amendment to remove the language on page 1 concerning medical marijuana. Senator Carroll stated that she feels removing mention of medical marijuana is misleading since only existing medical marijuana stores are eligible licensure on January 1, 2014, while all applicants are potentially eligible after October 1, 2014.

The committee discussed with Ms. Pramuk the feasibility of separating the costs of implementing the retail marijuana regulatory structure from the medical marijuana regulatory structure, and whether there was a good estimate of what those would be. Ms. Pramuk noted that the annual budget process would also play a significant role in the regulatory system funding. Representative Murray offered a conceptual amendment to address the costs of implementing the retail marijuana regulatory structure.

Ms. Pramuk responded to questions from Senator Scheffel concerning the expected projections and fund availability from the Department of Revenue regarding both medical and recreational marijuana. Senator Scheffel presented prepared Amendment 5 concerning language indicating that current fees and sales tax revenue are inadequate to provide an effective regulatory structure (Attachment D). The committee discussed the propriety of using "will not be funded" versus "may not be funded." Senator Scheffel withdrew his motion and offered a motion to amend the final Proposition AA draft with language that includes "may not be funded."

The committee continued to discuss business tax structures. Representative Priola stated that the current language may be misleading to voters who think that businesses may be able to choose different tax structures year to year. Representative Murray moved to strike language in the summary and analysis section about businesses choosing to report income and said that all businesses must report income, but choose the manner in which they report.

Representative Szabo presented prepared Amendment 9 to the Initiative 22 Final Draft that would add language to the "Arguments Against" section concerning discrepancies in county tax expenditures and receipts (Attachment L). Mr. Carey and Mr. Herreid responded to questions about whether there is data available concerning county tax expenditures and receipts compared to school district tax expenditures and receipts. They noted that there are some data limitations considering there are 178 school districts and only 64 counties in the state. They noted that accurate revenue numbers could be problematic since many school districts exist in multiple counties. Senator Scheffel discussed with the committee and Legislative Council Staff the possibility of adding a chart showing county tax expenditures and a chart showing school district tax receipts to the "Estimate of Fiscal Impact" section.
