The committee was called to order. A quorum was present. Representatives Levy and Gerou, prime sponsors, presented Senate Bill 13-288, concerning the process by which the General Assembly approves recommendations made by the State Claims Board for an additional payment to claimants that exceeds the maximum liability under the "Colorado Governmental Immunity Act." Representative Levy explained the effect of the bill. Representative Gerou provided further input on the effect of the legislation. Discussion ensued regarding the potential total cost for settling claims made against the state associated with the Lower North Fork Wildfire. Representative Levy provided background on the claims process for the fire. Representative Gerou explained how claims associated with other fires differ from those associated with the Lower North Fork Wildfire.

Representative Young, prime sponsor, presented Senate Bill 13-278, concerning creating a definition of a "drug-endangered child" with respect to child abuse or neglect. Representative Young discussed the need for the legislation, and explained the bill's effect. The following persons testified regarding Senate Bill 13-278:

Ms. Annmarie Jensen, representing the Colorado Drug Investigators Association and the Colorado Association of Chiefs of Police, testified in support of the bill. Ms. Jensen discussed the appointees to the Substance Abuse Trend and Response Task Force, created by Senate Bill 13-244. Ms. Jensen discussed the problem of children residing in a home where illegal drug activity or drug abuse is taking place, and issues associated with this problem. Ms. Jensen discussed the benefits of creating a statutory definition of "drug-endangered child," and provided background on efforts to create this definition. Ms. Jensen then discussed the effect of the bill. Ms. Jensen responded to questions regarding the effective date of the bill.

Mr. Ken Summers, representing Teen Challenge, testified in support of the bill. Mr. Summers discussed the impact of drug abuse on children, and provided background on child welfare investigations, with examples of issues related to substance abuse and families. Mr. Summers responded to questions regarding the potential inclusion of alcohol in the definition of "drug-endangered child," and the potential for legal users of marijuana to have their families impacted by enforcement efforts under the definition.

Mr. Brandon discussed the potential fiscal impact of the bill on emissions testing customers, and the implementation of the bill. Mr. Brandon discussed the two types of automobile emissions violators.

Mr. Garry Kaufman, representing the Air Pollution Control Division within the Department of Public Health and Environment, made himself available to answer questions about Senate Bill 13-257. Mr. Kaufman addressed questions raised about the bill earlier, providing background on the bill's implementation date and the decision not to select a certain date upon which to base automobile emissions exemptions. Mr. Kaufman responded to questions regarding the reasoning behind selecting 2016 as the implementation year for the bill. Mr. Kaufman responded to questions regarding his agency's position on implementing the bill in 2016, and the recent history of air quality violations in the Denver area. Mr. Kaufman responded to further questions regarding the use of on-board diagnostic equipment to test vehicle emissions.
