Representative McCann announced that the presentation by the Colorado Behavioral Healthcare Council would be rescheduled for another date.


Representative Levy presented House Bill 13-1181 concerning the retention in a cash fund that funds tobacco programs of the lesser of all unencumbered moneys remaining in the fund at the end of any fiscal year or an amount of such moneys equal to five percent of the amount appropriated from the fund fro the fiscal year. The bill allows programs that receive tobacco litigation settlement moneys to increase their spending authority under certain conditions. The bill does not change the statutory allocation of tobacco litigation settlement money distributions. It establishes separate cash funds for programs that do not already have a dedicated cash fund and allows, at the end of a fiscal year, a cash fund to retain up to five percent of the amount appropriated. Representative Levy responded to questions from the committee about tobacco litigation settlement moneys, tobacco revenues, and the creation of cash funds by the bill. A handout concerning the bill was distributed to the committee (Attachment A).

01:30 PM -- House Bill 13-1180

Representative Gerou presented House Bill 13-1180 concerning the allocation of tobacco litigation settlement moneys that were originally to be allocated to the Nurse Home Visitor Program but are currently scheduled to be transferred to the general fund. The bill restores the distribution of tobacco master settlement agreement moneys to the Nurse Home Visitor Program, less amounts that are redirected to the Defense Account of the Tobacco Litigation Settlement Cash Fund. The bill makes technical amendments to clarify the Nurse Home Visitor Program's share of tobacco master settlement agreement moneys. A handout concerning the bill was distributed to the committee (Attachment B).
