02:10 PM -- House Bill 13-1183 - Concerning a Cap on the State Conservation Easement Credit

Representative Levy and Representative Gerou, prime sponsors, explained the provisions of the bill. Representative Gerou noted that under current law, the total amount of tax credits claimed for conservation easements is limited to $22 million for 2011 and 2012, and $34 million for 2013. This bill adds a limitation of $45 million beginning 2014, and extends that limitation indefinitely. Representative Levy noted that claims for tax credits are made in the order in which they are submitted. Any claims for tax credits that exceed the limit are placed on a wait list and given credit in a future year when the limitation has not been exceeded.

The following persons testified:

02:14 PM -- Mr. Ron Kirk, Legislative Council Staff, responded to questions about the state income tax credit for conservation easement donations and spoke to the revenue impact estimates in the fiscal note.

02:21 PM -- Mr. Greg Yankee, representing the Colorado Coalition of Land Trusts, testified in support of the bill.
