01:36 PM -- Senate Bill 13-029 - Concerning the Habitat for Humanity Income Tax Checkoff Program


Representative DelGrosso, prime sponsor, explained the provisions of the bill. He noted that Senate Bill 13-029 creates a new income tax return checkoff to collect donations for the Habitat for Humanity of Colorado Fund, a registered Colorado-based 501 (c)(3) public charity organization. After subtracting the Department of Revenue's programming costs and expenses to administer contributions, the remaining donated money would be transferred to the fund. Money in the fund would be used by organization affiliates of Habitat for Humanity to provide home ownership to low-income families.

02:03 PM -- House Bill 13-1206 - Concerning Business Incentive Agreements

Representative DelGrosso, prime sponsor, explained that House Bill 13-1206 modifies the cap for statutory business incentive agreements (BIAs) applicable to counties, municipalities, and special districts. Under current law, where a taxpayer has established a new or expanded business facility, local governments may, for a term of up to 10 years, enter a BIA that provides a taxpayer an incentive payment or credit up to the amount of the taxpayer's personal property tax liability. The bill adds authority for such BIAs to be formed with any taxpayer that the local government determines is at risk of relocating a business facility within the local jurisdiction to a location outside of Colorado.

Mr. Trever Clayton, representing himself, testified in opposition to the bill. Mr. Clayton noted that the bill would provide a tax incentive that may reduce the competitive environment of the state and result in businesses leaving the state. He closed by urging the committee to oppose the bill.

02:48 PM -- House Bill 13-1115 - Concerning the Repeal of CoverColorado

Representative McCann, prime sponsor, explained that due to the passage of federal health care reform, Colorado residents who are termed "high risk" will have options other than CoverColorado from which to obtain health insurance. Because there is no reason to continue CoverColorado, House Bill 13-1115 repeals CoverColorado as of March 31, 2015.
