10:36 AM -- House Bill 13-1237 - Concerning the Special Olympics Colorado Income Tax Checkoff Program

Representative Young and Representative Buckner, prime sponsors, explained the provisions of the bill. Representative Young began by saying that House Bill 13-1237 re-establishes the Special Olympics Colorado Fund income tax return checkoff program that was first placed on the tax form in 1997. The program sunset in tax year 2011 and was not extended by the legislature during the 2012 session. The Special Olympics Colorado Fund provides funding for athletic programs for Colorado children and adults with developmental disabilities. Fund money is used to purchase sports equipment, uniforms, and transportation services. Donations also fund training expenses and year-round event competitions.

After a brief committee discussion on the queue provisions in the bill and the notification requirement, Representative Court, Chair, asked staff to respond to questions.

Ms. Kate Meyer, Office of Legislative Legal Services, responded to committee questions. Ms. Meyer noted that the bill also requires the Department of Revenue to electronically notify an organization that appears on the state tax form and is in the Checkoff Colorado Program one year prior to the date on which the program is scheduled to sunset.

10:42 AM -- Mr. Ron Kirk, Legislative Council Staff, responded to committee questions about the cost of requiring the Department of Revenue to notify organizations on the form one year prior to their legislative sunset.

Ms. Mindy Watrous, representing Special Olympics Colorado, testified in support of the legislation. Ms. Watrous discussed the role of Special Olympics Colorado in terms of assisting the disabled. The committee discussed the notification requirement in the bill. Ms. Watrous responded by saying that they missed the statutory sunset date because they believed that all checkoff programs were now subject to the new five-year renewal period. She closed by saying that she did not know that the five-year program duration requirement was program specific. She closed by urging the committee to support the legislation.

10:56 AM -- Ms. Allison Hess, representing Special Olympics Colorado, discussed her personal experiences with Special Olympics Colorado and testified in support of the bill.
