11:17 AM -- House Bill 13-1225

Representative Williams, chair, called the meeting to order and stated that the committee would hear House Bill 13-1225 for action only. Representative Levy, prime sponsor, introduced two amendments, Amendment L.004 (Attachment A) and Amendment L.006 (Attachment B). Representative Levy described the provisions of Amendment L.004, a strike-below amendment to the bill, and also Amendment L.006, which made a technical change to the strike-below amendment. Representative Levy readdressed testimony from the previous committee hearing on House Bill 13-1225 which took place in the House Business, Labor, Economic and Workforce Development committee on February 26. She stated that the original intents of this bill were to: 1) be sure everyone had adequate time to rebuild and replace their home before their benefits expired, 2) try to get the policy limit closer to the actual cost of rebuilding, and 3) relieve people from the onerous task of content itemization.

Representative Levy discussed the provisions of Amendment L.004 in page-by-page detail. She stated that on Page 1, the new bill creates a definition for dwelling so that these policies apply only to primary single-family residences. She stated that on Page 2, lines 3-19, the new bill replaces mandatory offer language with a make-available clause. She discussed new minimums related to the limit of the insurance for the dwelling. She stated that she had fleshed out the plain language requirements to correspond to other plain language requirements in other insurance legislation that has passed. She stated that on Page 3, she deleted the language requiring insurance companies to do a re-estimate every two years, but maintained language to encourage insurance companies to consider contractor input. She discussed the addition of the word "furnished" to the section on total loss of home contents. She stated that the new bill offered a minimum of 30 percent of the value of the contents without having to submit an inventory; the amount was 25 percent in the original bill. Finally, the time period is expanded up to 270 days to submit inventory for a governor-declared disaster. Representative Levy responded to questions from the committee.

Representative Holbert moved Amendment L.005 (Attachment C), which added a line to the summary disclosure form language. Levy concurred that Amendment L.005 was a friendly amendment.

Representative Levy made closing comments on the bill. She stated that the issues of wildfires will continue in the state. She stated that the bill was not meant to place blame on insurance companies, but to help improve a product that everyone needs. She said that she hopes the bill will help homeowners to have adequate coverage for the most valuable investment they will make. Members of the committee made closing comments and commended Representative Levy for working so hard on the bill.
