09:04 AM -- HB 12-1278 Groundwater Study

Dr. Reagan Waskom, Colorado Water Institute, Colorado State University, explained that the General Assembly enacted House Bill 12-1278 concerning the South Platte river alluvial aquifer study. The act requires the Colorado Water Conservation Board (CWCB), in consultation with the State Engineer and the Colorado Water Institute, to conduct a comprehensive study to compile and evaluate available historical hydrologic data in the South Platte River Basin. The act directs the CWCB to contract with the Colorado Water Institute, which will conduct the study independently. The results of the study must be reported to the General Assembly by December 31, 2013. Dr. Waskom presented an animation that shows the development of water resources in the South Platte Basin and described the history and development of groundwater use regulations.

Dr. Waskom discussed technological developments that have increased understanding of groundwater hydrology and the effects of pumping on surface water users. He also played a video of a flight along the South Platte River that identified major water water features including diversion structures, tributaries, gravel mines, water storage facilities, and stream gauges. He also explained how groundwater pumping can affect surface flows, identified preliminary findings of the report, and discussed questions that may not be answered by the study including future groundwater levels.

Dr. Waskom discussed changes in surface flows and groundwater levels in the South Platte River and identified the amount of water used to augment out of priority diversions and other issues. He also responded to questions from the committee about maps and groundwater models used to conduct the study.

10:12 AM -- Joint Water Resources Review Committee and Wildfire Matters Review Committee

Senator Schwartz, Chair of the Water Resources Review Committee and Senator Nicholson, Chair of the Wildfire Matters Review Committee, called the meeting to order and discussed overlapping interests of the committees.

Travis Smith, Superintendent of the San Luis Valley Irrigation District, Rio Grande Basin representative on the Colorado Water Conservation Board, and member of the Interbasin Compact Committee, provided an update on impacts in the Rio Grande Basin from recent wildland fires and describes the activities of the Rio Grande Watershed Emergency Action Coordination Team. He discussed the need for the state to take a more active role in forest management on federal lands to protect watershed and other resources. He also discussed measures to promote watershed resiliency and stewardship agreements (Attachment A) and responded to questions from the committee about post fire impacts to reservoirs and the cost of mitigating these impacts.

Senator Roberts explained that the Water Resources Review Committee requested Draft Bill 4 to create watershed roundtables. However, the bill is not ready to be recommended to Legislative Council. Instead she will work with Mr. Smith and other interested persons to develop similar legislation to protect watersheds.

Representative Mitsch Bush identified local watershed protection efforts occurring across Colorado including the Routt County community wildfire protection (CWPP) plan that was developed in response to recent federal and state legislation. Specifically, the federal Healthy Forest Restoration Act directs federal agencies to collaborate with communities in developing hazardous fuel reduction projects and in the prioritization of treatment areas as defined by a CWPP. In 2009, the Colorado legislature enacted Senate Bill 09-001 to establish CWPPs at the county level to address fire hazard areas within unincorporated areas.

Mr. Smith continued to discuss his proposal to promote watershed resiliency and stewardship agreements. He also discussed the role of watershed protection in basin implementation plans of basin roundtables and the development of the Colorado Water Plan. He responded to questions from the committee about post-fire impacts to watershed and the time required to return a watershed to pre-fire conditions.

Lisa Dale, Colorado Assistant Director, Department of Natural Resources, discussed local forest collaboratives that work with private landowners and federal agencies to manage forest health, protect watersheds, and address other issues.

Ms. Dale responded to questions from the committee about federal moneys provided to states that can be used for forest health and watershed protection projects. She also described a recent meeting in Montrose to discuss policies to promote forest health in Colorado and other states and she discussed the federal weight limit for interstate highways and its effect on vehicles transporting timber in Colorado.

Senator Schwartz announced that U.S. Senator Mark Udall is sponsoring legislation to allow the Federal Emergency Management Agency (FEMA) to work with states and local entities on wildfire mitigation projects. The bill places wildfires on par with other natural disasters, such as hurricanes, floods and tornadoes, and makes Colorado and other states eligible to receive an additional 15 percent of the total funds FEMA allocates for fire suppression to support wildfire mitigation efforts..

Paul Cook, Director, Division of Fire Prevention and Control, responded to questions from the committee about fires related to agricultural burns and the provisions of Draft Bill 3. He also discussed the authority of counties to regulate open burning and fireworks.

11:38 AM -- Flood Impact to Oil and Gas Facilities

The committee returned from recess. Tisha Shuller, President and CEO, Colorado Oil and Gas Association (COGA), described the impacts of recent floods on oil and gas development facilities in the South Platte River Basin and discussed the oil and gas industry's preparedness for flood events (Attachment C). She described the industry's response to the September flood including shut-ins of wells, the deployment of personnel, well monitoring, incident response, containment, cleanup, and reporting to state and federal regulatory agencies. She described daily updates provided by COGA during the flood and assessed the impact of the flood on the oil and gas industry. Ms. Shuller expressed concern about misinformation in the media about spills and other environmental impacts related to flood damaged oil and gas facilities and described COGA's efforts to correct that misinformation. She identified specific oil spills that occurred as a result of the flood and described the result of water quality testing by the Colorado Department of Public Health and Environment. She also discussed volunteer flood relief provided by the industry to flood impacted communities

Ms. Shuller answered questions from the committee regarding oil release incidents that occurred as a result of the flood, lessons learned from the flood, and the need to change best management practices and regulations to ensure that oil and gas facilities are able to withstand catastrophic floods.

01:35 PM -- Water Banks

The committee returned from recess. Rob Sakata, Colorado Ag Water Alliance (CAWA), explained that CAWA sponsored a workshop on valuing agricultural water and he introduced Dr. Bonnie Colby.

Dr. Bonnie Colby, University of Arizona, described her research concerning voluntary agreements to address water supply problems throughout the world. She identified Colorado water policies that enable voluntary water transfers and discussed state funding to develop alternatives to agriculture transfers (Attachment D). She explained how water banks help manage risk and supply variability and can help with interstate water delivery obligations, protect habitat, provide water for higher value crops, and increase the reliability of junior municipal and industrial water rights. She identified elements of successful water banks, such as providing benefits for multiple types of users and providing a seamless interface with agencies that are responsible for the administration of water rights. She also identified potential impacts to third parties from water banks and discussed methods for avoiding or mitigating these impacts.

Dr. Colby explained how water banks can be used to store conserved water for use during water shortages and she identified states that allow transfers of conserved water including Montana, Oregon, and California. She explained how contingent transfer agreements may also benefit from water banks and identified methods of financing water banks including administration fees based on the amount of water that is moved through a bank. She recommended that the Colorado Water Plan encourage water bank pilot projects and recognize the value of temporary water transfers.

Mr. Sakata discussed the need to find alternatives to the permanent transfers of agricultural water rights.

Dr. Colby responded to questions from the committee about policies in other states that allow the transfer of conserved water and the types water that may be conserved and transferred to another purpose.


02:18 PM -- Precipitation Collection Pilot Project

Harold Smethills, Sterling Ranch, LLC, explained how water efficiency and demand management are being use to address the water needs at Sterling Ranch, including the use precipitation collection, also called rainwater harvesting (Attachment E). In 2009, the legislature authorized a 10-year pilot program for the collection of precipitation from rooftops for nonpotable uses. The purpose of the program is to develop data and methods to measure local precipitation, native plant consumption, and ground water flow. It will also evaluate precipitation collections designs and determine how to prevent injury to water rights. Mr. Smethills discussed annual precipitation at Sterling Ranch and how precipitation collection can be used to provide a reliable water supply for lawns and gardens. He identified measures to ensure that precipitation collection facilities do not impact downstream water users. He also discussed runoff from Sterling Ranch during the September 2013 floods and explained how this information will be used to determine how to operate the precipitation collection system in a way that protects downstream users.

Beorn Courtney, Professional Engineer, Sterling Ranch, LLC, responded to questions from the committee about the amount of water that will be consumed on average by each Sterling Ranch household and how this compares with typical household in other developments.

02:42 PM -- Water Storage and CWCB Construction Fund Bill

Tim Feehan, Deputy Director, Resource Management, Colorado Water Conservation Board (CWCB), explained that the 2014 CWCB Construction Fund bill will include a loan of $66 million for the Chatfield Reservoir Reallocation Project. The total cost of the project is expected to be $145 million. He responded to questions from the committee about the Chatfield Reservoir Reallocation Project and the use of the CWCB loan moneys for the project. The 2014 bill will also include a loan of $55 million for the Water Infrastructure Supply Efficiency (WISE) Project.

James Eklund, Director of the CWCB, responded to question from the committee about the need for loans from the CWCB Construction Fund to rebuild infrastructure damaged by the recent floods and other needs.

Mr. Feehan responded to questions from the committee about moneys appropriated alternative for agriculture transfers (ATMs) and he estimated severance tax revenue that will be available for water loans and grants in future years.

Mr. Eklund responded to questions from the committee about state moneys available for water projects and the use of the Colorado Water Plan to prioritize state spending for water projects.

Mr. Feehan explained that current law allows the CWCB to issue loans of up to $10 million without approval by the General Assembly. He also discussed CWCB policies that guide prioritization of loans and grants from the CWCB Construction Fund and the Perpetual Base Account.


03:06 PM -- Need for DWR Water Well Inspectors

Joe V. Meigs, Legislative Chairman, Colorado Water Well Contractors Association, explained that the current water well inspection program was authorized in 2003. Specifically, Senate Bill 03-045 expanded the regulation of water well construction contractors and pump installers by creating a well inspection program that is administered by the State Board of Examiners of Water Well Construction and Pump Installation Contractors and increased well inspection fees to pay for well inspections. He described the responsibilities of water well inspectors and explained how well inspection fees are used to pay for salaries and other expenses related to the well inspection program. He described recent changes in the number of well permits that are granted and the effect of these changes on funding available for the well inspections. He urged the legislature to authorize two additional well inspectors and to pay for this increase by increasing well inspection fees from approximately $100 to $150 per well.

Robert Longenbaugh, representing himself, commented on the House Bill 12-1278 groundwater study and requested that the committee listen to a broad range of opinions from the water community prior to making any legislative recommendations. He also discussed the need for additional data to ensure that ground water models used to regulate pumping are accurate.

He responded to questions from the committee about the Colorado Farm Bureau's positions on the draft bills.
