01:33 PM -- House Bill 12-1328

Representative Priola, prime sponsor, presented House Bill 12-1328. Under current law, the rates and charges and the disclosure of rates and charges of a licensed pawnbroker are specifically excluded from the general provisions of the Uniform Consumer Credit Code (UCCC). The bill clarifies that the pawnbroker exclusion to the UCCC applies to pawnbrokers whether licensed by a local licensing authority, regulated by a local governing authority under Section 12-56-102, C.R.S., or authorized to make supervised loans under Section 5-2-301, C.R.S. The UCCC exclusion applies so long as the rates and charges do not exceed an agreed upon amount, not to exceed one-fifth of the original purchase price for each month, plus the original purchase price. Representative Priola distributed a fact sheet about the bill (Attachment A).

Matt Will, representing the Colorado Pawnbrokers' Association and Mister Money, testified in support of the bill. He talked about stores that are in unincorporated counties that do not issue business licenses and the need for this legislation to keep those stores in business. Representative Liston asked how many pawn brokers there are in the state. Mr. Will estimated that there are about 80-90 in his association and maybe an additional 60 that are not a part of the association. Mr. Will responded to questions regarding the rates and charges in the bill. Representative Liston asked Mr. Will to walk the committee through the process of pawning an item.

Erin Goff, representing Colorado Pawnbrokers' Association, testified in support of the bill and explained the need for the bill.




01:54 PM -- Laura Udis, administrator of the UCCC in the Attorney General's Office, stated her office is neutral on the bill, but wanted to provide some background on the issue. She also talked about an amendment that they would like to see included in the bill. Ms. Udis responded to questions from the committee.

02:13 PM -- House Bill 12-1004

Representative Bradford, prime sponsor, presented House Bill 12-1004. This bill requires county and municipal building codes to allow and encourage the use of lumber milled from lodgepole pine or Engelmann spruce trees having a grade of "stud" or better for the framing of buildings. Representative Bradford explained that in light of the recent forest fires, she would like to refocus the bill and ask that it be moved to the Committee on Agriculture, Livestock, and Natural Resources.
