Senator Aguilar, chair, called the meeting to order. She asked Senator Carroll to explain the change to page 3, line 7 of the bill. Senator Carroll discussed the difference between being immune from liability and not being subject to liability. Representative B. Gardner asked for further clarification about not being subject to civil liability. Senator Carroll provided more explanation about the difference. Discussion ensued on this subject between Senator Carroll and Representative B. Gardner. Representative B. Gardner indicated that the "immune from" language is in a companion bill that has already been signed. He expressed concerns about having slightly different language in the same section of the Colorado Revised Statutes. Representative Levy agreed with Representative B. Gardner. Senator Carroll continued to discuss her opinion about language related to immunity and liability.

Senator Carroll indicated that she understood the need to keep the "immune from" language for the sake of consistency in the statutes, although she thinks it would have been better to use the "is not subject to" language in both bills. Representative Levy continued to discuss the scope of the immunity covered by the bill. Senator Roberts commented that the bill contains sufficient qualifying language to assure that employers are held accountable with respect to negligence.
