11:01 AM -- Discussion and Vote on Resubmitted Plans for Senate and House

The commission was called to order. A quorum was present. Commissioner Carrera recapped the commission's actions at its November 28th meeting. Mr. Jeremiah Barry, Colorado Reapportionment Commission Staff Director, briefed the commission on the sequencing of Senate elections and the impact of reapportionment on these elections. Commissioners received a handout showing the sequencing of Senate elections for the four Senate plans under consideration (Attachment A). Commissioners also received House Resubmitted Plan Gv1 and the associated political competitiveness analysis (Attachments B and C).

Discussion ensued regarding House Resubmitted Plan Gv1, which is a new map, and the process for considering House maps. Commissioner Berry discussed input she has received on House Resubmitted Plan Fv1 from persons on the Western Slope, and discussed her reasons for opposing the plan. Commissioner Witwer discussed the merits of House Resubmitted Plan Gv1 as compared to House Resubmitted Plan Fv1.

Discussion ensued regarding the introduction of House Resubmitted Plan Gv1, and the process observed by the commission in considering resubmitted House plans. Discussion followed regarding what materials are on the commission's record of proceedings. Commissioner Witwer discussed the potential for considering additional reapportionment plans and amendments after a vote was taken on November 28th to end consideration of additional plans, and the deadlines for submitting plans after the initial plans were remanded. Commissioner Carroll commented on protocol observed by the commission, and recapped the debates that took place during the commission's November 28th meeting about the timing of the submission of certain reapportionment plans.

Senator Carroll moved Senate Resubmitted Plan Ev1 (Attachment E). Commissioner Nicolais compared the merits of Senate Resubmitted Plan Ev1 to other Senate plans before the commission, including the number of parts of counties added to other counties, and suggested that the plan may be remanded by the Colorado Supreme Court. Commissioner Webb recapped some of the commission's activities during the reapportionment process, including some of the actions taken in a bipartisan manner. He also discussed the action taken by the Colorado Supreme Court on the plans submitted by the commission, and subsequent commission activities. He discussed public input on certain plans, and district competitiveness in the adopted resubmitted House plan. Commissioner Tool revisited the issue of deadlines for submitting reapportionment plans and amendments after the Supreme Court remand.

Discussion ensued regarding the plan submission deadlines established after the Supreme Court remand, and the distinction between a plan amendment and a new plan. Commissioner Atencio discussed the deadline for submitting the resubmitted reapportionment plans to the Supreme Court, and the constitutionality of the Boulder County portion of Senate Resubmitted Plan Ev1. Commissioner Witwer revisited the issue of deadlines for submitting resubmitted reapportionment plans.
