Representative Miklosi, prime sponsor, presented Senate Bill 10-118 to the committee. The bill, recommended by the Legislative Audit Committee, authorizes the Department of Human Services to obtain a fingerprint-based criminal history record check on a person who provides care to a child who is related to him or her if the child's care is funded with moneys from the Colorado Child Care Assistance Program (CCCAP). Representative Miklosi gave an overview of the provisions the bill.

Herb Covey, representing the Adams County Department of Human Services, testified in support of the bill. Mr. Covey expressed concerns about what has happened with exempt providers in Colorado and gave an overview on the cost of criminal background checks. Mr. Covey said that he is concerned with the financial impact on exempt providers in the state. Mr. Covey responded to questions from the committee concerning exempt providers and licensed child care in the state.

Leslie Bulicz, representing Colorado Department of Human Services, Division of Child Care, testified in support of the bill. Ms. Bulicz discussed a performance audit of the CCCAP that found that state statute gives the department the authority to require background checks only for providers who receive CCCAP funds for caring for children that they are not related to, but that the department has been requiring the checks for all individuals who receive CCCAP funds. Ms. Bulicz responded to questions from the committee.

Representative Riesberg noted that Eric Johnson, representing the Office of the State Auditor, was present to answer questions of the committee. There were no questions for Mr. Johnson.

Representative Miklosi noted that the Colorado Compassion Initiative (CCI) supports the bill.
