The committee returned from recess. Senator Tochtrop described the provisions of Senate Bill 10-098 concerning the allocation of moneys to promote conservation of the state's natural resources (Attachment B). She also distributed Amendment L. 002 (Attachment C) and L. 004 (Attachment D). Amendment L. 002 strikes everything below the enacting clause, essentially creating a new bill under the original title. Amendment L. 002 allows each county, municipality, or special district that has created a conservation trust fund to cooperate or contract with a conservation district or a local noxious weed control program. Cooperation includes the sharing of moneys for the acquisition, development, and maintenance of new conservation sites. Amendment L. 004 amends Amendment L.002.

Jo Evans, Colorado Audubon, spoke in opposition to the bill and described how lottery proceeds are allocated by the Colorado Constitution. Article XXVII, Section 3 (b) of the Colorado Constitution, the Great Outdoors Colorado Amendment, specifies that the Division of State Parks and Outdoor Recreation receives 10 percent of net lottery proceeds; the Conservation Trust Fund receives 40 percent of net proceeds; and the Great Outdoors Colorado Trust Fund receives the remaining 50 percent of net proceeds up to $35 million, adjusted for inflation.

02:09 PM -- Bruce Eisenhauer, Deputy Director, Colorado Department of Local Affairs, spoke in opposition to the bill and explained that the Colorado Constitution allocates 40 percent of the net lottery proceeds to the Colorado Trust Fund for local governments to acquire, develop, or manage open lands and parks. He also responded to questions from the committee about how local governments use Conservation Trust Fund moneys.

Brian Starkebaum, Colorado Association of Conservation Districts, spoke in support of the bill and responded to questions from the committee about potential use of the lottery moneys to manage weeds and provide other conservation services (Attachment E).
