11:30 AM -- House Bill 10-1279 - Concerning Liquor-Licensing Practices for Grocery Stores

Representative McFadyen, prime sponsor, presented House Bill 10-1279. The bill allows grocery stores to apply to state and local licensing authorities for conversion of a retail liquor store license to a liquor-licensed drugstore license beginning January 1, 2011. She briefly discussed the bill and requested the committee to postpone House Bill 10-1279 indefinitely. After committee discussion, Representative Judd, Chairman, asked for public testimony and placed the bill on the table for action. No one testified on the legislation.

11:31 AM -- HCR10-1008 - Concerning the Appropriation of State Expenditures

Representative Lambert, prime sponsor, explained that House Concurrent Resolution 10-1008 submits a constitutional amendment to voters to require that all expenditures by the state be appropriated by law. It also clarifies that no moneys in the custody of officers of the state may be disbursed without a legal appropriation. The amendment would be referred to voters at the 2010 General Election.

The committee engaged in a brief discussion about the definition of custodial funds as it relates to the bill.

Mr. Troy Bratton, representing the Office of Legislative Legal Services, responded to committee questions about the definition of custodial funds. Mr. Bratton noted that the resolution would not apply to federal money that is awarded to the state for a specific purpose and would exclude grant-money awarded by the federal government to state agencies. Mr. Bratton closed by saying that the term custodial funds has been used by the U.S. Supreme Court to refer to funds that are not generated from tax revenue but provided by the federal government for a specific purpose.

04:33 PM -- Senate Bill 10-133 - Concerning A State Income Tax Credit for Rehiring Employees


Representative Rice, prime sponsor, briefly explained that Senate Bill 10-133 creates a state income tax credit for tax year 2011 available to Colorado businesses that hire individuals who have been laid off and have been receiving unemployment benefits since March 31, 2010. The credit is equal to $1,000 for each hired employee. Businesses can only claim up to five credits each for a total of $5,000. Any credit amounts that exceed a taxpayer's income tax liability cannot be refunded to the taxpayer, but can be carried forward and used on future tax returns for five years.

The committee engaged in a brief discussion on whether the state income tax credit in the bill would generate jobs.

Representative Scanlan, prime sponsor, presented Senate Bill 10-206. Current law provides a series of triggers and exceptions related to the distribution of a portion of money in the Limited Gaming Fund. This bill removes those triggers and exceptions beginning in FY 2010-11, and every fiscal year thereafter. Representative Scanlan explained the provisions of the bill. After a brief discussion, the bill was placed on the table for action.
