Brita Darling, Office of Legislative Legal Service, distributed a draft of the first report of the first conference committee on House Bill 10-1364 (Attachment A). Senator Steadman raised concerns about the applicability of the proposed language and stated his belief that it might cause confusion. The committee discussed whether only new offenders entering treatment should be given multiple choices about treatment providers or whether the same choice should be offered to offenders already in treatment. Discussion about the options available to an offender who is unhappy with his or her treatment provider ensued. The amended bill requires each supervising agency to create a process by which an offender in treatment may seek a review and determination by his or her supervising agency of the appropriateness of his or her treatment provider.

Senator King wanted to make sure that offenders in urban and rural areas have the right number of provider options. Representative Levy expressed her concern that the supervising agency also include options for offenders when providers are determined not to be the best treatment option for those particular offenders. The committee spent time wordsmithing with Ms. Darling and determined the best language to use in the conference committee report.
