Representative Nikkel, prime sponsor, presented House Bill 10-1259, concerning amendments to the "Municipal Annexation Act of 1965" in order to conform the act to provisions of the state constitution. Representative Nikkel explained that the bill conforms statutory provisions with Section 30 of Article II of the state constitution, which was approved by the voters in 1980. The bill also clarifies legal arrangements and applies to both past and future municipal annexations. Representative Nikkel discussed the differences between annexation provision in the constitution and state statutes. She also discussed concerns by the Colorado Municipal League concerning provisions in the bill that would allow the bill to apply to both past and future annexations. She explained that an amendment had been prepared to address the concerns of the Colorado Municipal League.

Munsey Ayers, attorney, representing himself, testified in support of the bill, discussed his experience in annexation law, and talked about the prepared amendment that would prevent the bill from applying to past annexations.

Gerald Dahl, attorney, representing Colorado Municipal League, testified in support of the bill and discussed the need for prepared amendment L.001 (Attachment A). Mr. Dahl discussed the differences between annexation provisions in the state constitution and state statutes, talked about the history of the Municipal Annexation Act, and explained the four sections of the bill amended by L.001. Mr. Dahl addressed questions concerning the changes that would be made to the bill under amendment L.001.
