Representative Scanlan, prime sponsor, presented House Bill 10-1368, concerning a modification to planning requirements affecting county governments to clarify that political subdivisions are not exempt from county approval of land-use development under the "Planned Unit Development Act of 1972." Representative Scanlan explained that the bill originated from a recent state Supreme Court case, the Board of County Commissioners of the County of Boulder v. the Hygiene Fire Protection District,where the fire protection district was authorized to acquire land within a planned unit development in Boulder County.

Pat Ratliff, Colorado Counties Inc., addressed the committee to discuss the ruling in the Hygiene case and how the ruling could change the relationship between county governments and other special districts. Ms. Ratliff explained that local entities would be meeting during the interim to discuss the ruling in the Hygiene case and possible changes in state law.
