11:02 AM -- House Bill 10-1368

Representative Scanlan, prime sponsor, presented House Bill 10-1368, concerning a modification to planning requirements affecting county governments to clarify that political subdivisions are not exempt from county approval of land-use development under the "Planned Unit Development Act of 1972." Representative Scanlan explained that the bill originated from a recent state Supreme Court case, the Board of County Commissioners of the County of Boulder v. the Hygiene Fire Protection District,where the fire protection district was authorized to acquire land within a planned unit development in Boulder County.

Pat Ratliff, Colorado Counties Inc., addressed the committee to discuss the ruling in the Hygiene case and how the ruling could change the relationship between county governments and other special districts. Ms. Ratliff explained that local entities would be meeting during the interim to discuss the ruling in the Hygiene case and possible changes in state law.

11:09 AM -- Senate Bill 10-181

Representative McKinley, prime sponsor, presented Senate Bill 10-181, concerning the authority of a municipality to lease lands owned by the municipality. The reengrossed bill gives municipalities the additional option to lease lands that were purchased to acquire water rights. Under current law, municipal water providers may purchase lands that are connected with the acquisition of water rights and may only hold or sell these lands. Representative McKinley addressed questions from the committee and discussed the need for local governments to have the option to lease property acquired for water rights.

Geoff Wilson, Colorado Municipal League, spoke in support of the bill, explained the need for municipalities to lease property purchased for water rights, and responded to questions from the committee.

Representative McKinley distributed prepared amendment L.001 (Attachment A), which would prevent municipalities from leasing property for the purpose of expanding a military installation. Committee discussion ensued concerning the amendment.
