Representative Riesberg presented Senate Bill 10-194. Under current law, home care agencies must be licensed by the Colorado Department of Public Health and Environment (CDPHE). A home care agency provides skilled home health services or personal care services in a person's residence. The bill requires community centered boards (CCBs) to be licensed as home care agencies by March 1, 2011. Representative Riesberg stated that the bill will eliminate the duplicative licensing for early intervention service providers as they are regulated by the Department of Education and the Department of Health Care Policy and Financing. A handout in support of the bill was provided to the committee (Attachment G).

Dr. Art Hogling, Alliance, spoke in support of the bill. He explained that Senate Bill 08-153 required home care agencies to be licensed through the Department of Public Health and Environment. He stated that many CCBs provide services for disabled infants in a home care setting. He stated that under Senate Bill 08-153, some CCBs would be required to register as home care providers. He stated that CCBs are already well regulated by the Department of Human Services. The committee discussed the services provided by CCBs.

Representative Riesberg provided concluding remarks on the bill. He stated that the bill provides a definition of early intervention service providers and allows time for the department to review whether CCBs should be licensed as home care providers. The committee discussed whether another bill in the next legislative session would be necessary. Representative Riesberg stated that the department could promulgate rules so that CCBs would be exempt from licensure as home care providers.
