08:04 AM -- Consideration of Draft Committee Legislation

The committee was called to order. A quorum was present. Ms. Deborah Haskins, Office of Legislative Legal Services (OLLS), presented a draft of proposed committee legislation, "Capitol Dome Restoration Funding." Committee members received a copy of the draft legislation, prepared by OLLS (Attachment A). Committee members also received a memorandum about cause marketing, prepared by Legislative Council Staff (Attachment B). Ms. Haskins walked the committee through the draft legislation and explained the new powers and duties granted the Capital Development Committee (CDC). She clarified the advisory role of the Capitol Building Advisory Committee (CBAC) to the CDC regarding fund-raising proposals for the State Capitol dome restoration project. Ms. Haskins addressed questions about page 4, lines 17 through 19, of the draft legislation. Discussion ensued.

Ms. Haskins continued her presentation of the draft legislation. Discussion ensued about the use of the phrase "tasteful and appropriate" on page 5, lines 11 through 12, of the draft legislation. Ms. Haskins continued her presentation of the draft legislation and discussed the provisions of the bill concerning the transfer of donations to the Capitol Dome Restoration Trust Fund established by the proposed legislation. Representative Riesberg told the committee that CBAC is required to report on its recommendations to both the CDC and the Executive Committee of the Legislative Council (Executive Committee). He then suggested a two-year sunset on the new powers created by the bill in order to limit the duration of a fund-raising campaign.

Discussion ensued about the reporting requirements to the Executive Committee. Ms. Haskins addressed a question about the frequency of reports from the CBAC to the CDC and the Executive Committee regarding fund-raising proposals for the State Capitol dome restoration project. Discussion ensued. Senator Bacon suggested that the CDC report intermittently to the Executive Committee regarding its actions and recommendations regarding fund-raising for the project. Senator Kopp commented on certain provisions of the bill. Discussion returned to the inclusion of a two-year sunset on the bill.

Ms. Lisa Esgar, Deputy Director, Governor's Office of State Planning and Budgeting (OSPB), came to the table to comment on page 6 of the draft legislation, and said that OSPB would like there to be an appropriation for the project prior to any expenditure rather than allowing the Department of Personnel and Administration broad spending authority. Discussion ensued about the necessary project approvals required prior to expenditures from the Capitol Dome Restoration Trust Fund established by the proposed legislation. Discussion continued about the timing of certain transfers to the Capitol Dome Restoration Trust Fund for the State Capitol dome restoration project. Senator Schwartz suggested that the bill should clearly state that funds should be made available for the project when a contract is signed, rather than when moneys are due.

Mr. Larry Friedberg, State Architect, Department of Personnel and Administration, came to the table to discuss how the state's contracting process works. He said his office does not authorize the commencement of any projects without funds on hand. He clarified that the State Capitol dome restoration project could be requested, approved, and appropriated in multiple phases. Ms. Esgar responded to a question about the supplemental process and ways in which the project can be approved during an interim. Discussion ensued.

The committee directed OLLS to incorporate changes suggested during the meeting and agreed to consider a revised draft of the proposed legislation at its April 6, 2010, meeting. The committee adjourned.
