02:41 PM -- House Bill 10-1152

Representative Frangas, prime sponsor, returned to the committee to discuss House Bill 10-1152 concerning the civil rights of persons with disabilities. The bill was originally referred by the Judiciary Committee to the Committee on Appropriations on Thursday, February 18, 2010. The bill was then referred back to the Judiciary Committee by the House Committee of the Whole. The bill, as amended by the House Judiciary Committee, makes several changes to state law concerning civil rights law and discrimination against persons with disabilities. Specifically, the bill does the following:

allows the Colorado Civil Rights Commission and the courts to impose a fine on persons and organizations found guilty of violating the civil rights of a person with disabilities of up to $10,000 for a first offense, and up to $25,000 for a repeat offense;
prohibits state agencies and public entities from discriminating against persons with disabilities who are eligible to receive a government service or to participate in a public program, and specifies the type of relief and damages allowed in the event of such discrimination;
standardizes and increases misdemeanor penalties for several existing civil rights violations, and creates new misdemeanor offenses for violating specific rights of persons with disabilities;
identifies damages and allows for payment of attorney costs in various civil rights cases involving persons with disabilities;
clarifies and updates the rights of persons with and trainers of assistance animals; and
allows a person who is retaliated against for filing a complaint with the state Medicaid program to receive damages.

Joan Zivic, Automobile Association of America (AAA) Colorado, spoke in opposition to the bill. Ms. Zivic stated her opinion that the focus of the bill should be on increasing accessibility for people with disabilities rather than increasing penalties and damages for violations. She expressed concern that the bill will create a burden on business owners. Ms. Zivic responded to questions from the committee.

Tony Gagliardi, National Federation of Independent Business, spoke in support of the bill. Mr. Gagliardi discussed litigation that has occurred as a result of similar legislation in California. He expressed his opinion that the bill is bad for small businesses. He asked the committee to lower the fine to $1,000 per violation or to simply kill the bill. Mr. Gagliardi responded to questions from the committee.

Julie Reiskin, CCDC, spoke in support of the bill. Ms. Reiskin stated her opinion that most disabled individuals simply want to get through the day and do not file lawsuits until they have exhausted all other options. She disagreed that the bill would lead to increased litigation. Ms. Reiskin responded to questions from the committee.

Representative Levy called the committee back to order.

Representative Primavera, sponsor, presented Senate Bill 10-076 concerning unreasonable insurance claims settlement practices. The reengrossed bill prohibits an insurance company from providing a financial incentive to a person for the purpose of influencing that person's decision to deny or delay a claim, or to cancel or rescind an insurance policy. In civil actions on claim denials, the court may instruct the jury that such financial incentives are prohibited.

Ms. Campbell denied that the practice addressed by the bill currently takes place within the insurance industry. She stated that current law adequately addresses any unreasonable practices. She expressed concern about the broadness of the scope of the bill, which could lead to unintentional consequences. Ms. Campbell discussed the process of claims settlement.

Dr. Rochelle Cohen, Health Care for All Colorado, spoke in support of the bill. Dr. Cohen is a provider and consumer of health care insurance. She advocates comprehensive health care reform for the benefit of all Coloradans. She discussed her experience arguing with insurance providers on behalf of her patients and stated her opinion that such time spent is not productive or useful for the provider, the physician, or the patient. Dr. Cohen responded to questions from the committee about the role of a physician in the claims settlement process.

Dana Dzwonkowski, American Cancer Society, spoke in support of the bill. Ms. Dzwonkowski discussed specific instances of the unreasonable practices addressed by the bill.

Charlie Hebeler, Colorado Dental Association, spoke in support of the bill with amendment L.007. Ms. Hebeler talked about the need for the amendment, which requires that any determination that a covered benefit is not medically necessary, appropriate, effective, or efficient be made by an appropriate health care provider licensed in the United States. The committee discussed the amendment.

Melissa Collins, Colorado Chiropractic Association, spoke in support of the bill. Ms. Collins stressed that nothing in the bill prohibits the denial of claims for proper reasons. She discussed the fact that the practice addressed by the bill is not covered under current bad faith law. She expressed her opinion that the bill will not result in burdensome litigation. Ms. Collins testified that 16 other states have enacted this type of legislation. She responded to questions from the committee.

07:31 PM -- House Bill 10-1421

Representatives Weissmann and May, co-sponsors, presented House Bill 10-1421 concerning the decommission of a correctional facility operated by the Department of Corrections (DOC). The bill requires the DOC to close by November 1, 2010, one state-run correctional facility that has a bed capacity of at least 500. The DOC is to direct 20 percent of the savings realized in FY 2010-11 to the private prison per diem rate for programs that reduce recidivism. The bill does not specify which prison should be closed.

The committee discussed the reasons for accomplishing the goals of the bill through legislation rather than through the normal budget process. They talked about the impact to local communities when a prison is closed. The issue of recidivism rates at private prisons versus those at state facilities was discussed. Prepared amendment L.005 was distributed to the committee (Attachment U). Discussion about how best to use the savings generated by the bill ensued.

Karl Spiecker, DOC, testified about the bill. Mr. Spiecker stated his opinion that the bill is in response to a very unique economic climate. The inmate population is currently declining. The DOC staff is the most important asset of the department, according to Mr. Spiecker. He discussed the public safety mission of the DOC and the critical needs of the department. He stated that the DOC does not object to the provisions of the bill because it recognizes that the state is in such a unique position. He expressed his opinion that the department will be able to reorganize and reassign staff in the event that a prison closes. He does not believe that staff will be laid off as a result. Mr. Spiecker responded to questions from the committee about how the decision about which prison to close would be made. The committee continued to discuss the effect of the bill on the DOC.

Bailey Phelps and Scott Wasserman, Colorado Workers for Innovation and New Solutions (WINS), spoke in opposition to the bill. Mr. Phelps discussed the unique challenges of classifying inmates. He expressed his opinion that spending more money on private prisons is not the right thing to do. He spoke about the effects of the bill on the employees of the facility that is chosen to be decommissioned. Mr. Wasserman stated that his objection to the bill comes down to the effectiveness of private versus public prisons. The position of Colorado WINS is that the ideal correctional system is publicly operated. Mr. Wasserman responded to questions from the committee.
