Representative Vaad, prime sponsor, presented Senate Bill 10-016 , concerning modifications to the manner in which a civil penalty assessment notice of toll evasion evidenced by automatic vehicle identification technology is provided to the owner of a vehicle so identified. Representative Vaad explained that the bill originated with the Transportation Legislation Review Committee (TLRC) during the interim. He explained that the bill eliminates the second penalty notice requirement of camera-detected toll evasion and extends the time frame for payment or responses from 20 to 30 days from the penalty notice. He addressed questions from the committee, discussed the collection process by the E-470 authority, and distributed a handout to the committee (Attachment A).

John McCuskey, representing the E-470 Public Highway Authority, testified on the bill and explained the payment process by the E-470 all-electronic toll road, which collects tolls through the use of a transponder or by license plates. He explained that the bill would eliminate the second bill notice to save the authority money and resources. He stated that in 2009, the authority spent approximately $1.1 million sending out the second, certified mail notices.

Representative Vaad and Mr. McCuskey addressed questions from the committee concerning payment collections and bond indebtedness incurred by the E-470 toll road authority. Committee discussion ensued concerning the bond indebtedness of the E-470 toll road authority and other toll road projects in the state.
