01:37 PM -- Senate Bill 10-207

Representative Tyler, prime sponsor, presented Senate Bill 10-207, concerning authorization for the state treasurer to enter into lease-purchase agreements on behalf of the state to finance capital construction projects proposed by the Governor's Energy Office that improve the energy efficiency of state capital facilities. Representative Tyler was joined by Representative Levy. Committee members received a letter from the Chair of the Capital Development Committee notifying the members of their approval of the bill (Attachment A). Representative Tyler explained the effect of the bill. Representative Levy provided additional input on the bill's effect. Representative Tyler responded to questions regarding the timing of the bill's introduction. Representatives Tyler and Levy responded to questions regarding the funding limit on lease-purchase agreements under the bill. Representative Levy responded to questions regarding the ability to perform the bill's functions administratively without legislation.

The following persons testified regarding Senate Bill 10-207:

Mr. Brett Johnson, representing the Governor's Energy Office, testified in favor of the bill. Mr. Johnson discussed the need for the bill, and the benefits of using Certificates of Participation (COPs) to enhance the state's real estate portfolio, including using them for energy efficiency projects. Mr. Johnson explained the financing of COPs under the bill, and noted some of the projects that will be financed under the bill. Mr. Johnson also discussed the economic benefits of the bill, and potential future COP funding should the COP financed under the bill prove to be successful.

Mr. Rod Vanderwall, representing the Office of the State Architect, testified in support of Senate Bill 10-207. Mr. Vanderwall discussed potential energy cost savings to be realized under the bill, and explained the role of energy service companies under the bill.

Mr. Steve Truebner, representing Johnson Controls and the Energy Service Coalition, testified in favor of the bill. Mr. Truebner discussed the energy performance contract process, and explained some of the benefits of entering into energy performance contracts. Mr. Truebner responded to questions regarding the potential for the bill to result in job creation, and potential job losses in other industries due to the bill. Mr. Truebner responded to further questions regarding what constitutes an energy performance contract.
