Senator White, Chair, called to order the first meeting of the First Conference Committee on Senate Bill 09-101. Senate Bill 09-101 requires the creation of a 7-member independent historic preservation commission by any city that receives moneys from the State Historical Fund for historic preservation purposes when the city is not a certified local government.

MOTION:Representative Levy moved Amendment CLSB101.002 that reports that the First Conference Committee agrees that the Senate accede to the House amendments made to the bill and that the rerevised bill be adopted without change (Attachment A). A substitute motion was made (see following vote sheet). After discussion, both motions were withdrawn.

Amendment CLSB101 001 reports that the First Conference Committee agrees that the House recede from its amendments to the bill, as the amendments appear in the revised bill, and that the bill include an effective date of August 1, 2009. After discussion, both amendments were withdrawn.

Representative Levy explained why the House amended the reengrossed bill to allow the City of Black Hawk to appoint the members of the Independent Restoration and Preservation Commission.

Senator White explained why the reengrossed bill requires that the Gilpin Board of County Commissioners to appoint the members of the Independent Restoration and Preservation Commission to oversee spending from the State Historical Fund for projects in the City of Black Hawk. He also explained that the City of Black Hawk is not a certified local government. Committee discussion followed on whether there is an amendment that could address both the concerns of the House and Senate with the appointing authority for the commission. Representative J. Kerr explained that such a compromise may require the conference committee to go beyond the scope of the differences between the two Houses. Neither the House or the Senate have granted this permission. Senator White withdrew his substitute motion of Amendment CLSB101. 002 and Representative Levy withdrew her motion of Amendment CLSB101.001.
