Richard Sweetman, Office of Legislative Legal Services, described draft conference committee report CLSB226.004 (Attachment A). He explained that the draft report adds language to the rerevised bill requiring the State Board of Education to adopt rules related to a statewide allergy policy and school districts to also develop policies. Representative Gagliardi asked for clarification of the draft report's changes to rerevised bill. Senator Sandoval explained that the report references existing statutory language instead of repeating the language, as the rerevised bill did. Senator Hudak explained that the report also amends existing statutes related to a child who self-administers medication to specify that a school administrator may formulate a written treatment plan for students. Mr. Sweetman clarified this portion of the draft report.

Mr. Sweetman continued explaining CLSB226.004. He explained that the draft report requires institute charger schools to adopt measures that satisfy the statewide policy established by the state board. The report further removes language related to the self-administration of medications by students, incorporating existing statutes by reference. Senator Hudak commented on the Colorado Association of School Boards' position on the bill. Senator Sandoval commented on why having a statewide policy is important, in her view. The committee discussed the terminology of "promulgating rules" vs. "developing policy" to describe the duties of the State Board of Education in establishing the statewide allergy policy.
