01:13 PM -- Conference Committee on House Bill 09-1281

Representative Labuda initiated a discussion on House Bill 09-1281, concerning representation on state boards by persons with disabilities. Representative Labuda discussed differences between the two houses regarding which state boards are to be encouraged to include representation by persons with disabilities. Discussion ensued regarding the proscriptive language in the bill, and how the Office of the Governor will interpret the language in appointing members to certain boards. Representative Labuda discussed the potential for groups to request mandatory participation on certain boards in future years. Discussion followed regarding mandates in the rerevised version of House Bill 09-1281 pertaining to certain state boards. Representative Labuda discussed input she has received from the disability community on the bill. Ms. Sheryle Hutter, representing the Colorado Developmental Disabilities Council and the Colorado Cross-Disability Coalition clarified this input.

Senator Carroll M. weighed in on the proper compromise language for requiring certain boards to include representation from the disability community. Discussion ensued regarding potential redundant language pertaining to the Colorado Civil Rights Commission and the Medical Services Board. Discussion followed regarding the charge of the Medical Services Board, and the need to expressly require disability representation on the board. Discussion turned to potential compromise language.

Discussion ensued regarding the difficulties experienced by the Office of the Governor in fulfilling representation requirements when appointing members to certain boards. Discussion followed regarding the potential loss of the intent of House Bill 09-1281 if proscriptive language is changed to permissive language, and the need to encourage participation by the disability community on state boards. Discussion turned to the options available to the conference committee in going forward with the bill.
