Representative Curry, prime sponsor, presented Senate Bill 09-293 concerning changes to certain Tier 2 transfers out of the operational account of the severance tax trust fund to compensate for a projected revenue loss in that fund for the 2009-10 state fiscal year. The reengrossed bill modifies statutorily authorized transfers from the Operational Account of the Severance Tax Trust Fund that fund a variety of Tier 2 programs. Specifically, the bill reduces the transfer to the Water Supply Reserve Accountof the Severance Tax Trust Fund by $3 million in FY 2008-09; eliminates a conditional transfer to the Water Efficiency Grant Program Cash Fund; reduces the transfer to the Capital Account of the Species Conservation Trust Fund by $6.5 million and increases the transfer to the Operation and Maintenance Account of this fund by $2 million in FY 2009-10; reduces the funding for energy-related assistance to low-income households by eliminating transfers to the Department of Human Services Low-Income Energy Assistance Fund and the Governor's Energy Office Low-Income Energy Assistance Fund and reducing the transfer to the Energy Outreach Colorado Low-Income Energy Assistance Fund by $1.625 million in FY 2009-10; reinstates a $13 million transfer for low-income energy assistance in FY 2012-13; reduces the HB 09-1199 transfer to the Healthy Forests and Vibrant Community Fund by $500,000 in FY 2009-10; and reduces expenditures from this fund specified in HB 09-1199. Representative Curry answered questions from the committee.

Benjamin Waters, representing the Colorado Farmers Union, Julie McKenna, representing the Northern Colorado Water Conservation District, and Crystal Korrey representing the Colorado Farm Bureau and the Colorado Cattlemen's Association had signed up to testify on the bill but all passed.
