Senator Heath introduced three students from Fairview High School who were visiting. The students explained their position on Colorado Student Assessment Program (CSAP) assessments and their ideas for improving CSAPs. They distributed a letter to the committee (Attachment A).

Senator Hudak, sponsor of House Bill 09-1125, brought her bill back before the committee for action only. The bill was heard, and testimony was taken, on February 25, 2009.

Senator King explained amendment L.008 (Attachment B), saying it allows students to be paid for services rendered. The committee discussed the amendment.

Senator Hudak reminded the committee that bill prohibits schools from offering incentives for students to enroll. She responded to committee questions.

11:02 AM -- House Bill 09-1229

Senator Isgar, sponsor of House Bill 09-1229, presented the bill. The bill is a Legislative Audit Committee bill that removes the requirement that auxiliary facilities at higher education institutions lose enterprise status on a specific date, instead allowing auxiliary facilities to remain enterprises so long as they otherwise satisfy the criteria for enterprise status. He provided a handout (Attachment C) providing information on the bill and responded to committee questions.

Senator Isgar responded to additional committee questions, including a question from Senator Spence asking for clarification about the effect of the bill.

John Karakoulakis, Colorado Department of Higher Education, testified in support of the bill. He noted that the department and all of the institutions are in favor of the bill. He provided examples of facilities that qualify as enterprises.

Mr. Karakoulakis responded to committee questions. The committee discussed issues around enterprise status for higher education institutions.

Committee discussion continued, with questions for Senator Isgar around the effect of the bill. Senator Isgar explained that enterprises are audited each year and the findings are reviewed by the Legislative Audit Committee.

Lou Skull, Office of the State Auditor, was present to answer questions, but there were none.

Senator Isgar made closing comments to the bill, talking about issues faced by institutions with enterprise status who receive capital funding.
