Senator Schwartz presented Senate Bill 09-162. The bill amends statutes adopted in 2008 for the creation of an inventory of broadband service areas within the state by allowing for the acceptance of public funds to help finance the creation of the inventory, extending the deadline for completion of the inventory from April 1, 2009, to November 1, 2009, and extending the repeal date for the statutes governing creation of the inventory from July 1, 2009, to January 1, 2010. Senator Schwartz explained the bill.

The following individuals testified:

01:50 PM -- John Conley, Deputy Director of the Governor's Office of Information Technology, testified in support of the bill. He discussed changes made by the bill and distributed a fact sheet to the committee (Attachment B). He stated that the bill would allow the Office of Information Technology to take full responsibility of any stimulus money and noted that the bill does not require appropriations from the General Fund.

01:54 PM -- Phil Weiser, a Professor of Law and Telecommunications at the University of Colorado in Boulder, testified in support of the bill on behalf of the Colorado Innovation Council. He discussed the importance of the bill and its relation to actions by Congress. Mr. Weiser responded to questions from Senator Mitchell regarding private vendor oversight compared to public oversight.
