Senator Tochtrop introduced House Bill 09-1061 and distributed amendment L.008 (Attachment K). The bill requires that intermediaries that contract with health insurers to comply with the same standards, guidelines, medical policies, and benefit terms as the insurers with whom they contract. In addition, payments to health care providers must indicate the name of the intermediary and the contracting insurance carrier. Violations of the bill are an unfair or deceptive act in the business of insurance.

Ellen Caruso, representing the Colorado Chapter of the American Physical Therapy Association, described a scenario in which an intermediary might limit care authorized under an insurance plan. She said the bill will allow consumers to receive more information about the entities limiting care in such situations.
