Senator Bacon, sponsor of House Bill 09-1267, presented the bill. The bill is in response to a 2008 decision by the U.S. 10th Circuit Court of Appeals, which found that Colorado's law prohibiting state financial assistance to students attending a pervasively sectarian institution is unconstitutional. The bill strikes statutory language pertaining to "pervasively sectarian" institutions and replaces it with language that prohibits state assistance to students pursuing degrees in theology or degrees in preparation for careers in theology.

John Karakoulakis, representing the Department of Higher Education (DHE), testified in support of the bill. Senator Spence asked how the bill relates to the Blaine Amendment. Senator Romer responded and committee discussion ensued. Mr. Karakoulakis reminded the committee that the money goes to the students rather than the institution.
