Senator Hodge, sponsor, described the provisions of HJR 09-1002 that lists the projects that qualify for financial assistance from the Drinking Water Revolving Fund and the Water Pollution Control Revolving Fund. In order to qualify for financial assistance from the revolving loan funds, proposed projects must be included on the project eligibility lists, which are created by the Division of Local Government, Water Quality Control Commission, and Colorado Water Resources and Power Development Authority. This annual joint resolution also makes deletions and modifications to the Drinking Water Project Eligibility List and the Water Pollution Control Project Eligibility List previously approved by the General Assembly. She also distributed Amendment L 001 (Attachment B) that expands the list of eligible projects due to the passage of the federal American Recovery and Reinvestment Act of 2009 (ARRA) and Amendment L. 002 that gives priority for Category 1 through 5 projects in the use of ARRA moneys (Attachment C). To ensure that all additional funds appropriated to the state under the ARRA are fully utilized, the Water Quality Control Commission held a rulemaking hearing on March 9, 2009, to establish an additional category (Category Six) of projects eligible for potential funding from the Drinking Water Revolving Fund and the Water Pollution Control Revolving Fund and has developed a list of Category Six projects to be included on the Drinking Water Revolving Fund and the Water Pollution Control Project Eligibility List that are identified in Amendment L. 001.

The following persons testified on the resolution:

10:51 AM -- Dan Law, Colorado Water Resources and Power Development Authority, spoke in support of the resolution and identified public drinking water and wastewater projects that would receive funding under the resolution (Attachment D). He compared the terms that apply to funding from ARRA with other loans provided by the authority and described the Category 6 projects that will receive ARRA moneys. Mr. Law also stated that the Colorado Water Congress supports the resolution and responded to questions from the committee.
