Representative Miklosi responded to questions from committee members concerning the loan program in Boulder County, competition for private lenders and energy improvement districts for loans to homeowners for energy efficiency improvements, and the oversight board that has authority over energy improvement districts.

Jason Gelender, Office of Legislative Legal Services, addressed the committee to clarify the difference between special districts created in Title 32 and special improvement districts authorized in Section 31-25-501, C.R.S. Mr. Gelender also responded to questions concerning the taxing authority of energy improvement districts that would not be subject to the provisions of Section 20 of Article X, of the State Constitution, also know as the Taxpayer's Bill of Rights (TABOR), as created by the bill.

01:32 PM -- House Bill 09-1362

Representative May, prime sponsor of House Bill 09-1362, concerning the authorization to local governments to provide financial assistance to specified institutions of higher education, introduced the bill. He explained that the bill authorizes municipalities and counties to form community college service area districts and authorizes county governments to levy sales or property taxes for the purpose of providing financial assistance to specified state colleges within the district.

Marsi Liddell, President, Aims Community College, and John Giardino, Colorado Mountain College, testified against the bill and discussed the need to include junior colleges, like Aims and Colorado Mountain College, in the bill to allow sales tax revenue to help fund capital construction projects for junior colleges. They explained the reasons that junior colleges needed to be included in House Bill 09-1362.

Barbara McDonnell, Colorado College System, testified in support of the bill and talked about the importance of creating additional funding for all colleges in the state.

Stephen Jordan, President, Metro State College, testified in support of the bill and in support of prepared Amendment L.001 (Attachment E). Dr. Jordan discussed the amendment and responded to questions from committee members concerning the additional costs to taxpayers within community college service areas created by the bill.

Representative Middleton introduced prepared Amendment L.001 (Attachment E) and explained the amendment to the committee members. Committee discussion ensued concerning L.001 and the fiscal impact of the amendment.
