The committee was called to order. A quorum was present. Mr. Jeremiah Barry, Office of Legislative Legal Services (OLLS), presented a draft committee bill, "Concerning The Transfers of Money to the State Museum Cash Fund," which reduces the amount of the transfers from the State Historical Fund to the State Museum Cash Fund scheduled to occur on or before October 1, 2009, and October 1, 2010. Committee members received a copy of the draft legislation, prepared by OLLS (Attachment A). Mr. Barry summarized the impact of the bill and explained that it makes changes to Senate Bill 08-206 in order to accommodate lower-than-expected limited gaming revenue in FY 2008-09. The bill will be introduced in the House and be sponsored by Representative Riesberg and Senator Bacon.

Representative Riesberg discussed the progress of a proposed higher education reform bill that would, in part, increase flexibility for higher education capital construction funding. He asked the committee whether it wants to sponsor committee legislation allowing for increased flexibility for higher education capital construction spending. Discussion ensued. Mr. Barry explained that the provisions of a higher education reform bill presented to the Joint Budget Committee (JBC) on Tuesday, March 17, 2009, are very different than earlier draft legislation OLLS prepared for the CDC. Discussion turned to what Mr. Barry should include in draft committee legislation concerning increased flexibility for higher education capital construction.

Representative Riesberg summarized the outcome of the JBC's March 18, 2009, figure setting for capital construction. He said the JBC recommended CDC state-funded priorities #1 through #5. Attachment B shows the CDC's priority list.
