Dan Cartin, Deputy Director, Office of Legislative Legal Services, reviewed the legislative policies related to public records and e-mail with the committee (Attachment A). He explained that the policy covers members and legislative staff, and has been forwarded by the Committee on Legal Services for the committee's review and approval. He explained the amendments made by the Committee on Legal Services to the policy document. Representative Weissmann asked if the policy contains guidelines on individual member's e-mail retention practices.

Representative May also asked about e-mail retention practices, specifically about his personal practice of deleting e-mails on a daily basis. Senator Shaffer stated that he believes that the policy is about access to e-mails, but not rules on management of e-mails retention. Mr. Cartin replied that Senator Shaffer's assessment is correct.

Representative Weissmann asked whether it is required that the committee adopt a policy. Representative May explained that he believes each member is capable of managing his or her own e-mail, and pointed out that the members pay for their e-mail accounts, not the state.
